INSTALLER / OWNER RESPONSIBILITY / LIABILITY / WARRANTY
It is the owner/installers/contractor/designer/architects responsibility to be certain that the installer is licensed by the State wherein the flooring or decking is being installed and that the installer is qualified to install the flooring and or decking product, and any other products associated with the installation. Keoni’s Teak Flooring & Decking accepts no responsibility for any defects or failure to the flooring or decking due to the faulty installation of their products, as well as the inexperience and or lack of qualifications of the installer.
Prior to installation, the installer must determine that the job-site environment meets the requirements established in the manufacturer’s installation instructions, Keoni’s Policies and Procedures and the State code. The surface/s that the flooring and or decking are being installed must be properly prepared prior to installation. Further more all-concrete surfaces must be tested for Ph levels, moisture emission levels, moisture content and or unusual conditions. Said test must not exceed those limits set forth by industry standards and or specific product manufactures. Keoni’s Teak Flooring & Decking and the manufacturer decline any responsibility for job or product failure resulting from or associated with sub-surface, job-site environment deficiencies and or faulty installation. The flooring product should acclimate a minimum of four to five days (or when the installer deems appropriate), in the same environment it is being installed in, prior to the installation.
The installer has final inspection responsibility and has the responsibility to hold out or cut-off pieces with any defects, whatever the cause. Should an individual piece be doubtful as to its suitability (color, finish, milling etc.), the installer should not use the piece. Whenever a board is installed, it has been deemed to be accepted by the installer and or owner.
Our Pre-finished, unfinished flooring and decking are sold as natural products and therefore not perfect. Our products are subject to variations in color and grain. They are also subject to minor expansion/contraction resulting from environmental conditions and is not considered a defect. Additionally, as a mass-produced natural product, it is subject to slight milling errors. These errors should not exceed generally accepted industry standards of not more then 5% of the total square footage installed. Any minor variation in milling should not exceed .4mm (IAW NWFA standards). In addition, there may be minor variations in floor height due to slight imperfections in the sub floor and/or surface. Said imperfections are the responsibility of the installer to detect prior to the installation. Our product is manufactured in accordance with accepted industry standards, which permit a maximum of 5% defect tolerance. These defects may be from manufacturing or natural type. When our product is ordered, an additional 5% must be added to the actual area needed. Additional waste may occur do to the layout and or design of the floor or deck.
Wood flooring is fragile and will be damaged by normal construction debris and activities by other trades; even if covered by paper. With the exception of baseboard installation and painting touch-up, installation should occur AFTER all plumbing, tile, electrical, HVAC, painting and all other work has been completed. Seller is not responsible for flooring damage if installed contrary to this schedule.
Whenever the product’s limited manufacturer’s warranty applies, the manufacturer’s liability is limited to replacing or repairing, at the option of the manufacturer, would apply to the material in excess of the 5% industry standard only, excluding all other costs such as transportation, storage, installation, cutting allowance, etc. The Manufacturer’s Warranty shall supersede the Seller’s Warranty whenever applicable. In further consideration of the sale of the Seller’s product, Buyer agrees to indemnify, hold harmless, and defend Seller against any and all liability, loss, damage, or expense incurred by the buyer which results, indirectly or directly, from any claim or judgment relating to defects in the product, or any part thereof. There are no other warranties, express or implied, of merchantability, fitness for any particular purpose or otherwise with respect to the product. Keoni’s Teak Flooring & Decking liability & warranty of the products is in accordance with that of the manufactures limits only. Keoni’s Teak Flooring & Decking is a distributor of these products and accepts no responsibility over and or above those stated and offered by the manufacturer.
Explanation of Terms and Ordering
Stocked Merchandise; Standard stocked product in inventory in Maui Warehouse.
Back Order; Products out of stock that may require 90-120 days or more for re-stock and availability*.
Special Order; Products not stocked but available in different stains and finishes. A special handling fee of 10% per order will apply to all special orders and may require additional delivery time. A minimum order is required (*) and will be determined by the manufacturer. Contact Keoni’s for a quote.
Custom Orders; Products not stocked, but require special milling and or processing. A minimum order is required.(*) and will be determined by the manufacturer. Contact Keoni’s for a qoute.
Larger Orders; Products that exceed a minimum of 10 pallets. Larger orders require a lead-time that is determined by the size of the order and mill conformation.* Contact us directly for details.
Payment
Payment: All deposits and payments that exceed $500 may be required to be wire transferred.
Checks: All checks must be cleared before they are considered accepted. Out of state checks can take in excess to twelve days.
Stocked Merchandise; 25% deposit with all orders. Balance due prior to delivery.
Back Order; 25% deposit with all orders. Balance due prior to delivery.
Special Order; 50% deposit with all orders. Balance due prior to delivery. Down payments are non-refundable. Special orders are non returnable and non refundable. All Special order sales are final.
Custom Orders; 100% deposit is required in all customs orders. Deposits are non-refundable. Custom orders are non returnable and non refundable. All Custom order sales are final.
Larger Orders; 25-50% deposit depending on the product type.
Deposit; All deposits must be cleared before your order is secured. All payment balances must be cleared prior to delivery.
Taxes; State of Hawaii General Excess Tax will be charge on all orders. A .5% GET will be applied to all re-sellers (GET Licensed Merchants). A 4.166% GET will be applied to other orders. All sales in the County of Oahu are subject to the January 2007 increase of .5%.
Returns & Refunds All special and custom orders are non refundable.
All returns and refunds are null and void after 90 calendar days from acceptance of products.
“Unopened” and “undamaged” “stocked” merchandise is returnable. These returns apply only to the “additional 5% of product” that is order to cover natural defects and milling errors. There will be a 10% handling fee for all returns.
There will be a 20% handling fee for any complete orders that are returned with in 90 days from acceptance.
Cancellations are subject to the deposit policy as stated above.
Any defective merchandise that exceeds the 5% industry standard shall be subject to the sole discretion of the Manufacturer.
(*) Orders that require confirmation from the mill with regard to availability, milling and production schedule.
